Facts Found| | 1. The protest was heard under rule 63.3(b) as the protestee was not present. 2. Immediately prior to the start of race 1, FIN 204 was almost stationary on starboard tack above the layline to the committee boat and to windward of CHN 1009. 4. At the start, CHN 1009 tacked to port in front of FIN 204 and there was contact between the boats, causing damage to FIN 204's bow sprit. 5. When FIN 204 hoisted the genakker after rounding the windward mark, the retractable bowsprit failed completely and she retired from the race. 6. FIN 204 made every effort to replace her bow sprit, but was unsuccessful and therefore unable to race in races 2 and 3.

Conclusion| | 1009 failed to keep clear as required by rule 10, and also broke rule 14. FIN 204 is entitled to redress under rule 62.1(b) for races 1, 2 and 3 of the final series.
